TERMS & CONDITIONS CONTRACT

The above-listed client (the "Client") and Photographer (Photographer)

agree that the Photographer will provide photography services as

outlined in the appointment's confirmation email. This is a legally-

binding contract.

This contract represents the entire understanding of the requirements,

schedule, and payment terms for the photography services.

Under copyright law, the photographer owns the copyright and can use it

for any editorial/ publication use without permission of the person in the

picture.

If there are any disputes or actions resulting in legal proceedings related

to this contract, such actions shall take place in and be subject to the

laws of North Carolina.

Clients accept sole financial responsibility for any legal fees or related

costs incurred by the Photographer in enforcing the terms of this

photography contract. Any failure by one or both parties to uphold or

enforce a provision of this contract shall not constitute a waiver of any

other provision of this contract.

Applying filters and posting the photos is prohibited. Posting proof

images is also prohibited. Failure to comply will result in legal action.

Please only post the edited photos that was sent to you. Understand that

any other edits that aren't done by me, is a poor reflection of my our company.

Thank you for your cooperation on this.

Payment

The Client agrees to retain the Photography for the services listed above

by signing this portrait photography contract and paying deposit via the

Photographer's acuity booking website. Client acknowledges that no

reservation can be made prior to the signature of this contract and

subsequent payment of the initial service deposit.

The remaining balance for the above listed portrait photography services

shall be paid in full on the day of the session. In the event that payment

is not made in full by this deadline, SUPERB STUDIOS reserves the right to

terminate this contract, retain the initial deposit, and no longer be held

liable for providing further services to the Client.

Deposit

The initial deposit that The Client made via SUPERB STUDIOS

booking website is NONREFUNDABLE. Should The Client cancel the

appointment and fail to reschedule The Client FORFEITS the deposit

payment already made.

Arrival Time

Please be sure to arrive on time for your session. Late arrivals result in

shorter sessions. If the client runs more than 10 minutes late, a

surcharge fee of $15 will be added to the final payment. No additional

time will be granted. The photoshoot session will end at the time

specified in the appointment booking. Failure to pay the $15 late fee

when sent the invoice will result in client not receiving the proof images

from session until the payment is made in full. Anything over 35 minutes

will result in an automatic cancellation of your session. If a photographer is late for any

reason, we will make sure to reach out to make client(s) aware. In this

case, your session will last the entire time booked.

Reschedule

All appointments that are cancelled due to an emergency may be

rescheduled. There are no refunds, only rescheduling. If you are wanting

to cancel appointments for any other reason, I ask that you cancel 48

hours prior to your session and reschedule no later than 2 business

weeks after your canceled appointment. Should the Photographer be

unable to accommodate the Client's rescheduled date, the Client will not

be held responsible for the remaining balance of this portrait

photography contract, but will forfeit their initial deposit. There is a

$65 rescheduling fee required before rescheduling a new appointment.

No call/No Shows will result in you losing the initial deposit. A brand

new shoot will need to be booked with a new deposit sent. Your initial

deposit can not be used towards your new shoot.

Liability

If SUPERB STUDIOS should be unable to provide the goods and services

outlined in this contract for any reason, SUPERB STUDIOS agrees to refund

any fees paid by the Client, minus applicable expenses, and shall have no

further liability with regards to this contract. This limitation of liability

also applies to any loss or damage to footage, photographs or other

materials after the events listed in this contract. The sole remedy for any

actions or claims resulting from the Photographer's inability to deliver

the goods and services listed in this contract shall be limited to a refund

of monies paid by the Client to SUPERB STUDIOS.

Digital Media

The Clients acknowledge that SUPERB STUDIOS does not always

maintain archives of images and footage after delivering requested

images and other goods to the Clients. It is the Client's sole

responsibility to request any desired prints, products, or files within 30

days of scheduled appointment.

Pricing

Any additional goods or services not included in this portrait

photography contract will be sold at then-current rates. SUPERB STUDIOS

makes no pricing guarantees outside of the terms of this contract, and

the Client acknowledges that prices for additional goods or services are

subject to change suddenly and without notice.

 

Responsibilities

SUPERB STUDIOS is responsible for bringing any lighting

equipment necessary to conduct the services outlined in this contract.

Client agrees to prevent any other photographers or videographers at

the shoot listed in this contract from interfering with the Photographer's

performance of their duties unless gained consent from SUPERB STUDIOS.

This includes guests and other amateur photographers or

videographers.

Turnaround Time

The standard turnaround time is 7-10 BUSINESS DAYS (MONDAY-

FRIDAY) editing period begins after client has selected images. If The Client purchases expedited images,

the new turnaround time is 2-3 BUSINESS DAYS.
